ACCEPTANCE OF TERMS

THESE TERMS OF SERVICE (“TERMS”) ARE A LEGAL AGREEMENT BETWEEN YOU (“YOU” OR “YOUR”) AND Jackpot Crush Casino Slots (JCCS). BY DOWNLOADING, INSTALLING ANY OF OUR APPLICATIONS (“APPLICATION”) AND USING IT IN CONNECTION WITH SERVICES PROVIDED BY US OR OTHERWISE ACCESSED THROUGH THE USE OF AN APPLICATION (SUCH SERVICES AND THE APPLICATION COLLECTIVELY, THE “SERVICES”) YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, ACCEPT AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR OTHERWISE USE THE SERVICE. YOU ALSO AFFIRM THAT YOU HAVE READ AND UNDERSTAND OUR PRIVACY POLICY.

IMPORTANT NOTE: These Terms contain a Dispute Resolution and Arbitration Provision, including a Class Action Waiver, that affects your rights under these Terms and with respect to any dispute you may have with the JCCS. You and the JCCS agree to submit disputes to a neutral arbitrator and not to sue in court in front of a judge or jury, except in small claims court. Please see Section 18 below for details.

You may opt out of the binding individual arbitration and class action waiver as provided below.

JCCS reserves the right, in its sole discretion, to modify or change these Terms at any time by posting the changes on or within the Application or other parts of the Service. Your continued use of the Service following the posting of such changes constitutes your acceptance of the revised Terms. JCCS may use reasonable commercial efforts to provide notice of material changes to you. If the modified Terms are not acceptable to you, your only recourse is to discontinue your use of the Service. You agree that JCCS may change any part of the Service, including its content, at any time or discontinue the Service or any part thereof, for any reason, without notice to you and without liability.

PRIVACY

You acknowledge and agree that JCCS will collect from you and your device, use, and share certain personal information as described in our posted Privacy Policy for the respective Services. By accessing and using our Services, you agree that you have read and acknowledge such Privacy Policies.

ELIGIBILITY

To engage with our Services, you must be an individual at least 18 years of age and the e-mail address holder associated with your account. We reserve the right to request proof of age. Non-compliance may result in account termination and forfeiture of any accumulated Virtual Items, including Loyalty Points.

LICENSE

To utilize our Service, ensure that your device is compatible with our App. We at JCCS cannot guarantee compatibility for all devices. By choosing to use our Service, you agree to adhere to our Terms and Privacy Policy. JCCS will grant you a personal, non-exclusive, revocable license to install and operate the App, limited to one copy for a single account on a device you own or lease.

Additionally, JCCS provides a limited license to access and use specific Service features outside of the App itself. This Service is intended for your private, non-commercial use exclusively for entertainment. Should local laws where you reside deem any part of the Service illegal, you are not permitted to use it.

Please note the following restrictions:

  • Do not alter, decode, or reverse-engineer the App.
  • The App should not be rented, shared, sub-licensed, sold, or used for any form of third-party service.
  • Avoid making duplicates of the App.
  • Do not bypass or disable any security, copying restrictions, or usage limitations of the App.
  • Retain all copyright and proprietary notices on the App.

We may occasionally release updated versions of the App and may even upgrade your version remotely. While we are under no obligation to do so, by using our Service, you consent to such upgrades. Subsequent updates will adhere to these Terms. The licenses provided do not constitute a sale of the App or any copies; all rights in the App and its contents remain with JCCS and our licensors or suppliers.

Finally, please be aware that standard carrier data charges may apply when using the Application.

VIRTUAL ITEMS

During your engagement with the Service, there may be instances when you can accumulate, invest in, or acquire (a) in-game virtual items or (b) virtual in-game currency, such as coins, cash, or points, all intended for use within the Service (collectively referred to as “Virtual Items”). It’s important to clarify that you do not truly “own” these Virtual Items and any purported balance does not equate to real currency or its equivalent. Instead, obtaining Virtual Items through accumulation, investment, or acquisition grants you a limited license to interact with the software embodiments of these items.

The transaction for acquiring a limited license to use Virtual Items is considered final once payment is redeemed. This transaction is non-refundable, non-transferable, and non-exchangeable, even if your Account is closed, these Terms are terminated, or if the Service is discontinued, except where law requires otherwise.

JCCS explicitly prohibits any off-service transfer of Virtual Items and does not recognize any related transactions, including but not limited to sales, gifting, or trading that may appear to originate from the Service unless JCCS has provided express written consent. Such transactions, including sublicensing, selling, or attempting to sell Virtual Items for real-world money, or trading them outside of the game context, are strictly forbidden without JCCS’s written approval. Any attempts at such unauthorized transfers will render them null and void and may lead to termination of your Account.

JCCS reserves the right to modify Virtual Item pricing at any moment without notice, for any reason, and holds no responsibility for any price fluctuations or changes in necessary virtual points for acquiring Virtual Items. Furthermore, JCCS retains the right to limit the quantity of Virtual Items that you may buy or to deny Virtual Item purchases without prior notice.

Loss of Virtual Items due to unauthorized activities like hacking, phishing, password mining, social engineering, or any other illicit third-party actions, holds JCCS harmless from liability. Nonetheless, JCCS may choose to replace lost Virtual Items at its discretion on an individual basis, without any obligation to do so.

All content present on or in the Service, including Virtual Items, is owned by JCCS, licensed to JCCS, or JCCS has rights to use such content. By accepting these terms, you acknowledge that you possess no rights or title to any service content, including Virtual Items, regardless of whether they are “earned” or “purchased” within the game or directly from JCCS.

LOYALTY POINTS

Through the Service, you have the chance to gather “Loyalty Points,” which act as virtual in-game credits. These points can be exchanged for additional Virtual Items within the Service. It’s important to understand that Loyalty Points do not represent actual ownership or any real-world currency balance. They simply grant a limited privilege to engage with the software manifestations of these points. Should any glitches affect Loyalty Points accumulation or reward redemption, JCCS holds the right to rectify such discrepancies.

EARNING LOYALTY POINTS

Engaging with the Service unlocks various ways to earn Loyalty Points. For instance, sharing your in-game triumphs on social media, showing appreciation for specific service features, participating in particular offers, or just playing games for a set amount of time can all contribute to your points. These illustrations are not comprehensive; there may be other opportunities to earn points that are not determined by game outcomes.

UTILIZING LOYALTY POINTS

Your Loyalty Points are exchangeable for Virtual Items or for other Rewards within the Service’s “Rewards” section. Redeeming a Reward necessitates an active, verified account. The initial redemption will require you to submit your name and email address, which must align with a government-issued ID of the person collecting Points through the Service.

When you use Loyalty Points to claim a Reward, it is akin to making a purchase. You’ll then have a set time frame to complete a “redemption process” by following specific steps outlined. Once a Reward is redeemed, it is earmarked for your use at a designated time and is considered “consumed” when utilized.

INACTIVE ACCOUNTS

If your account remains inactive, meaning you haven’t logged in through the service for 30 consecutive days, it will be considered inactive. To re-engage your account, simply log in and use the service. Please note that in the event of inactivity, JCCS holds the right to void any Loyalty Points you may have collected. Furthermore, if your account is recognized as inactive, JCCS may also, at its discretion, void any unredeemed Rewards you’ve purchased.

Policy Regarding Third Party Providers

Our affiliated partners retain full autonomy to modify, pause, or discontinue any of their offered programs, or any parts and terms of those programs, at their discretion. Such changes can be made at any given moment, with or without prior notification. By using this service, you acknowledge that JCCS will not be responsible for any inconvenience or loss as a result of such Partner actions.

Termination Policy

JCCS reserves the right to terminate or suspend your account—including but not limited to disallowing the purchase, redemption, or use of Rewards—and/or your access to the service, such as limiting your Application usage, at any time should you violate these Terms or for any other reason. These actions may be taken without prior notice to you and without any liability on our part. Subsequent to termination, all your privileges pertaining to the service, User Content, Virtual Items, and any accrued Loyalty Points will be revoked. JCCS might choose to retain User Content post-termination, but is not required to do so.

You retain the right to terminate your own account by ceasing to utilize the service and/or the Application. JCCS cannot be held responsible for any consequences resulting from termination or cancellation in relation to your access to the service or Virtual Items you have accumulated.

GENERAL RULES OF CONDUCT AND USAGE

  • By utilizing the Service, you confirm that you possess the lawful right and authority to enter into these Terms and abide by them. You commit to adhering to all relevant laws, regulations, statutes, and ordinances in connection with your utilization of the Service, as outlined by these Terms.
  • You pledge not to engage in fraudulent activities or attempt to deceive JCCS or other users. Nor shall you use the Service with malicious intent. Should JCCS deduce that your actions are malicious or unacceptable within reasonable societal norms, it holds the right to adjust your Loyalty Points, close your account, or ban you from future use of the Service at its sole discretion.
  • Examples of prohibited behavior include, but are not limited to:
  • If you are under 18, refrain from downloading the Application, creating an Account, or using any Service part.
  • Do not use the Service if you are in a country under U.S. embargo or listed as a Specially Designated National by the U.S. Treasury Department.
  • Avoid using the Service for any non-personal or unauthorized commercial means.
  • Do not access or tamper with non-public areas of the Service or the computer systems of JCCS and our partners.
  • Refrain from attempting to test, scan, or probe the vulnerability of any JCCS system or breach any security features.
  • Do not attempt to bypass, impair, or disable any protective measures put in place by JCCS or its providers to safeguard the Service.
  • Avoid using the Service on platforms or services not approved by JCCS.
  • Do not post, share, or transmit any content that infringes upon third-party rights or encourages illegal or harmful behavior.
  • Do not impede other users’ enjoyment of the Service or increase the cost of providing the Service for others.
  • Abstain from activities that undermine the integrity or intention of the Service.
  • Do not introduce viruses, worms, or other harmful code that could disrupt the Service or other users’ devices.
  • Refrain from sending unwanted advertisements or spam to other users.
  • Do not create fake identities, hold multiple Accounts, or try to circumvent loyalty point limits.
  • Do not solicit personal or financial information from other users.
  • Without JCCS’s explicit permission, avoid uploading or transferring any data collection tools.
  • Do not create or disseminate cheats, bots, hacks, or unauthorized third-party software.
  • Avoid exploiting or informing others of game errors that provide an unfair advantage.
  • Use Virtual Items only as authorized, and do not engage in the unauthorized sale or transfer of your Account or Virtual Items.
  • Access or use an Account or Virtual Items that have been sublicensed, rented, leased, sold, traded, gifted, bequeathed, or otherwise transferred from the original Account creator without JCCS’s permission;
  • Engage in any fraudulent activity with respect to payment methods or advertiser tracking mechanisms;
  • Violate any applicable law or regulation;
  • Attempt to interfere with, intercept or decipher any transmissions to or from the servers for the Service;
  • Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Service; or
  • Encourage or enable any other individual or group to do any of the foregoing.

DISCLAIMER OF WARRANTIES

The Service we provide, including our Application, is offered to you on an “as is” basis without any kind of guarantees. This means that JCCS, along with our partners, affiliates, and related entities or individuals (collectively referred to as the “JCCS Parties”), does not offer any explicit or implied promises regarding its functionality. Specifically, we do not guarantee that the Service will suit your specific needs, be continuously available, secure, nor free from errors.

Furthermore, the JCCS Parties do not endorse the quality, precision, timeliness, or integrity of any products, services, or information obtained via our Service. You, as the user, are entirely responsible for your exchanges with other Service users and any resulting consequences.

Please note that JCCS does not conduct background checks on Service users or assess the accuracy of their statements. There are no guarantees from JCCS concerning user behavior or compatibility. When interacting with other users, especially outside of our Service, we advise you to exercise caution. Certain legal jurisdictions may not accept disclaimers like the ones detailed above.

LIMITATION OF LIABILITY

By using our Service, including the Application, you accept all risks associated with its use. Should problems arise, neither the JCCS Parties nor any entity involved in the Service’s development will be responsible for any incidental, significant, or potential damages. This includes but is not limited to monetary losses, data loss, harm to goodwill, system malfunctions, or any physical injury or emotional strain experienced from using our Service or from interactions with other users of the Service.

JCCS’s total liability for any damages stemming from these terms or the use (or inability to use) the Service or its contents will not exceed $500. It is important to understand that the cap on potential damages is a crucial element of our agreement with you. If, however, your jurisdiction does not permit such limitations on liability, then these may not apply to you.

INDEMNITY

By using the service provided by JCCS, you agree to protect, reimburse, and spare JCCS Parties from any claims, damages, losses, liabilities, including reasonable attorneys’ fees and expenses, that may arise from your misuse of the service, any violations of these Terms by you, the content you provide, or any breach on your part of the promises you have made in this agreement. If JCCS must defend itself against any such legal claim, you will cover any costs incurred, and you commit to fully supporting JCCS in such defenses. JCCS will inform you promptly of any such legal proceeding if it comes to its knowledge. These indemnity obligations will outlast the termination of your account or your use of the services.

ADDITIONAL TERMS FOR MOBILE APPLICATIONS

When using the JCCS Application on an Apple iOS-powered mobile device, the following conditions apply:

  • You recognize that the contract regarding these Terms is solely between you and JCCS, not with Apple, Inc. (“Apple”).
  • You must use the iOS App in accordance with the App Store’s Usage Rules as set by Apple’s current App Store Terms of Service.
  • JCCS holds sole responsibility for the iOS App including all available services and content therein, and you understand that Apple has no obligation to offer maintenance and support services for the iOS App. Apple has no warranty obligations to the fullest extent permitted by law, and is not responsible for any other claims, losses, liabilities, damages, costs, or expenses caused by any failure of the iOS App to meet any warranty.
  • For any issues, claims, or concerns regarding the iOS App such as product liability, legal compliance, or consumer protection claims, JCCS (not Apple) will be responsible and such matters should be governed solely by these Terms and applicable laws concerning us as the provider of the iOS App.
  • If third-party intellectual property claims arise, JCCS (not Apple) is accountable for the investigation, defense, settlement, and discharge as required by these Terms.
  • You declare that (i) you are not in a country under a U.S. Government embargo, or designated as “terrorist supporting” by the U.S. Government; (ii) you are not listed on any U.S. Government list of banned or restricted parties.
  • You will adhere to any third-party agreements when using the iOS App. For example, you must not breach your wireless data service agreement while using the iOS App.
  • You consent to Apple being granted third-party beneficiary rights under these Terms concerning your license to use the iOS App. With the acceptance of these Terms, Apple will have the ability to enforce these Terms relative to your iOS App license as a third-party beneficiary.

With respect to the JCCS Application for Android-powered mobile devices, the subsequent conditions are applied:

  • You understand that these Terms are solely between you and JCCS, not with Google, Inc. (“Google”).
  • Your use of the Android App must comply with the current Google Play Terms of Service.
  • JCCS alone is answerable for the Android App, including all respective services, content, support, and maintenance. Google is not obligated or liable to you concerning the Android App or the Terms.

ENTIRE AGREEMENT

These Terms constitute the entire and exclusive understanding and agreement between JCCS and you regarding the Services, and these Terms supersede and replace any and all prior oral or written understandings or agreements between JCCS and you regarding the Services.

ASSIGNMENT

You may not assign or transfer these Terms, by operation of law or otherwise, without JCCS’s prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be of no effect. JCCS may assign or transfer these Terms, at its sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.

FORCE MAJEURE

JCCS is not responsible for any harm, injury, or service interruption caused by events outside of our control, including but not limited to natural disasters (such as earthquakes, hurricanes, and floods), public health emergencies, terrorist activities, failure of satellite or network services, laws or governmental orders, or labor disputes.
